COMMUNITY REINVESTMENT ACT NOTICE

Under the federal Community Reinvestment Act (CRA), the Federal Deposit Insurance Corporation (FDIC) evaluates our record of helping to meet the credit needs of this community consistent with safe and sound operations. The FDIC also takes this record into account when deciding on certain applications submitted by us.

Your involvement is encouraged.

You are entitled to certain information about our operations and our performance under the CRA, including, for example, information about our branches, such as their location and services provided at them; the public section of our most recent CRA Performance Evaluation, prepared by the FDIC; and comments received from the public relating to our performance in helping to meet community credit needs, as well as our responses to those comments. You may review this information today.

At least 30 days before the beginning of each quarter, the FDIC publishes a nationwide list of the banks that are scheduled for CRA examination in that quarter. This list is available from the Regional Director, Division of Depositor and Consumer Protection, FDIC 1601 Bryan Street, Suite 1410, Dallas, Texas 75201-4586. You may send written comments about our performance in helping to meet community credit needs to the CRA Officer, Global One Bank, 1400 Blalock Rd, Houston, Texas 77055 and the FDIC Regional Director.

You may also submit comments electronically through the FDIC’s Web site at www.fdic.gov/regulations/cra. Your letter, together with any response by us, will be considered by the FDIC in evaluating our CRA performance and may be made public.

You may ask to look at any comments received by the FDIC Regional Director. You may also request from the FDIC Regional Director an announcement of our applications covered by the CRA filed with the FDIC.

IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that on personal accounts identifies each person who opens an account. In addition on legal entity accounts, we will require identification on beneficial owners and controlling person. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.

BENEFICIAL OWNERSHIP NOTICE TO COMMERCIAL ACCOUNTS OR INCORPORATED ENTITIES

The government will require Customer Due Diligence (CDD) be performed on the Beneficial Owners of Legal Entity Customers, similar to that required for individuals opening accounts. Due to these regulatory changes we will ask for additional information when commercial accounts are opened or changes are made to existing accounts held at this Bank.

The Bank is now required to gather information as it relates to the following:

  • Ownership: Any individuals who directly or indirectly own 25 percent or more of the equity interests in the legal entity must be identified. This means that up to four individuals may be identified; in some cases, however, there may not be any individual identified if no individual actually owns 25 percent or more of the equity interest.
  • Control: Identify at least one individual who has significant managerial control over the legal entity customer. This individual could be an executive officer, a senior manager, or any other individual who regularly performs similar functions. An individual identified under ownership can also be identified as the controlling manager. This individual will certify the information provided is accurate and that if any changes occur the Bank will be notified.
  • Exempted: Sole proprietors and unincorporated associations
  • Grandfathered: This does not apply to accounts established prior to May 11, 2018, provided no changes are made to the accounts.
  • Renewals or Changes in Signors or Ownership: The completion of a Beneficial Ownership Certification will apply to all existing commercial customers (excluding those exempted) when they open new accounts, apply for a new loan, open a safe deposit box, an account change in ownership or signers, change of address, or change in legal entity status (For example, changing from a d/b/a to corporation or LLC, etc.).

ANNUAL DISCLOSURE STATEMENT

The Federal Deposit Insurance Corporation requires FDIC-insured State-Chartered Banks to make available on request, annual disclosure statements of the bank’s financial condition. CREDIT REPORT DISPUTES

Global One Bank may report information regarding your credit accounts with us to consumer reporting agencies and we make every effort to provide accurate information. FUNDS AVAILABLITY POLICY

Our General Policy is to allow customers to withdraw funds deposited in accounts on the first (1st) business day after the day we receive the deposit. Funds from electronic direct deposits will be available on the day we receive the deposit. Longer Delays May Apply: In some cases, we may delay the ability to withdraw funds beyond the first (1st) business day. Depending on the type of check deposited the funds may not be available until the second business day after the deposit. Then, the funds will generally be available by no later than the seventh (7th) business day after the day of deposit.

NOTICE TO BORROWERS CERTAIN LOAN AGREEMENTS MUST BE IN WRITING

TEXAS LAW (Section 26.02, Business and Commerce Code) requires that all financial institutions conspicuously post notices summarizing requirements that loan agreements be in writing. You should know that:

  • An agreement, promise, or commitment to loan more than $50,000 MUST BE IN WRITING AND SIGNED BY THE LENDER OR IT WILL BE UNENFORCEABLE.
  • The written loan agreement will be the ONLY source of rights and obligations for agreements to lend more than $50,000.
  • Oral agreements relating to loans over $50,000 are NOT EFFECTIVE either to establish a commitment to lend or to vary the terms of a written loan agreement.

As part of the documentation required for loans over $50,000, BORROWERS MUST BE PROVIDED AND MUST SIGN A NOTICE conspicuously stating that:

“THIS WRITTEN LOAN AGREEMENT REPRESENTS THE FINAL AGREEMENT BETWEEN THE PARTIES AND MAY NOT BE CONTRADICTED BY EVIDENCE OF PRIOR, CONTEMPORANEOUS, OR SUBSEQUENT ORAL AGREEMENTS OF THE PARTIES.”

THERE ARE NO UNWRITTEN ORAL AGREEMENTS BETWEEN THE PARTIES.

The notice set forth above, which must be signed by both the borrower and the Bank, can be in a separate document or incorporated in one or more of the documents constituting the loan agreement. The notice must be in type that is boldfaced, capitalized, underlined or otherwise set out from surrounding written material so as to be conspicuous.
